The HSE has reviewed its ‘MDHS 100′ guidance on asbestos surveying, which describes Type 1, 2 and 3 surveys and this document was replaced on 29th January 2010 with ‘Managing Asbestos in Premises, The Survey Guide (HSG 264)’, which describes management surveys and refurbishment/demolition surveys.
The HSE estimates that there are between half a million and a million non-domestic properties , within the UK, which still contain asbestos, and there will be an increasing requirement for the more invasive refurbishment/demolition surveys which are particularly demanding.
‘Managing asbestos in Premises, The Survey Guide (HSG 264)’ therefore places a far greater emphasis on competency.

Regulation 4 of the Control of Asbestos Regulations (CAR 2006) contains an explicit duty to assess and manage the risks from the presence of asbestos. The new asbestos survey guidance document, “Asbestos surveyors Guide – Surveying, sampling and assessment of asbestos-containing materials aims to help asbestos surveyors and duty holders ensure that proposed asbestos survey methods and procedures are appropriate for the situation and are able to be managed in sound and operational for all asbestos survey situations.
There are currently 3 methods of Asbestos survey as described within the surveyors guide (MDHS 100) a Type 1 asbestos survey, Type 2 asbestos survey and Type 3 asbestos survey of which in the near future, (subject to approval by HSE) will be revised to include 2 types of asbestos survey namely “management surveys” and “demolition/refurbishment” surveys.

The Health and Safety at Work Act 1974 requires an employer to provide a safe workplace. Asbestos, a category 1 chemical carcinogen, is subject to a specific set of regulations: the Control of Asbestos Regulations (CAR) 2006. These regulations cover work with asbestos, prohibitions on the importation, supply and use of asbestos, and licensing of asbestos removal activities.
In addition, there is a specific duty under CAR 2006 (introduced initially under the previous regulations ie the Control of Asbestos at Work Regulations (2002) and implemented in April 2004*) to manage the risks from asbestos containing materials (ACMs) in non-domestic premises.
